**How to Maintain Intellectual Property in the Lighting Industry: Lessons from the US and Effie**

Protecting intellectual property rights is essential for fostering innovation. The 19th National Congress of the Communist Party of China emphasized the importance of establishing a civilized society and strengthening the invention, protection, and application of intellectual property rights. This has set a clear direction for building an intellectual property power in the new era. China has increasingly focused on protecting intellectual property, introducing policies and programs to support this effort.
In 2017, the number of patent administrative cases handled reached 67,000, marking a 36.3% increase compared to the previous year. Meanwhile, the Patent Reexamination Board processed 28,000 cases (including 27,000 patent infringement cases), a 35% year-on-year increase. Additionally, 38,000 counterfeit patent investigations were conducted, rising by 37.2% year-on-year.
Intellectual property protection acts as a catalyst for business vitality and a key factor in shaping a favorable business environment. The state’s strategic planning for intellectual property rights will help advance professional protection in the lighting industry in China, offering great opportunities for its development.
As the lighting industry becomes more artistic and design-focused, it also faces challenges with imitation and plagiarism, which harm innovative entrepreneurs and discourage progress. However, many companies have not given enough attention to intellectual property rights. Weak awareness and lack of understanding often lead to economic losses and negative impacts.
In November 2017, the American brand Meishi·Effiet issued a notice regarding a ruling by the Guangzhou Intellectual Property Court, stating that Green Leopard had infringed on the U.S.-Effiet Paris crown series. This was the fourth patent victory for Effiet against Green Leopard in one year. The incident highlighted the critical need for better intellectual property protection in the lighting industry.
Meishi·Effiet has always prioritized intellectual property protection, achieving significant results. To understand their strategies, we interviewed Mr. Su Xiaogang, the legal director of Meishi·Effiet.
Mr. Su explained that while many lighting companies neglect intellectual property protection, the consequences can be severe. Both the infringer and the rights holder suffer losses, making it crucial for companies to take proactive steps.
Since 2014, Meishi·Effiet has focused on patent protection, not just through statements but through concrete actions. They have successfully handled over 80 patents, with more than 50 infringement cases and 29 formal representations won in 2017. Their success stems from a continuous standardization of internal processes.
Key lessons from Meishi·Effiet include:
1. **Strengthening Patent Protection to Avoid Legal Risks**
- Establish a “patent awareness†for product designs.
- Apply for full-range patents to cover all products and avoid gaps in protection.
- Avoid exposing patented products before filing for a patent, as early disclosure can render the patent ineffective.
2. **Implementing Confidentiality Measures to Protect Trade Secrets**
- Develop a multi-level protection system, including confidentiality agreements and non-compete clauses.
- Use technical measures such as monitoring USB ports and controlling access to production areas.
- Limit the number of people who have access to sensitive information.
3. **Establishing a Dedicated Legal or Anti-Counterfeiting Department**
- Focus on intellectual property operations and hire specialized personnel.
- Monitor the market for infringement and establish feedback channels.
- Work with professional legal organizations to ensure efficient and effective protection processes.
After the interview, Mr. Su emphasized that respecting and protecting intellectual property rights encourages innovation and promotes the healthy development of the lighting industry. With ongoing improvements in China's intellectual property judicial environment, more companies are expected to focus on and actively protect their intellectual property rights.
