Chapter I General Provisions
Article 1 According to the "Decision of the State Council on Strengthening Energy Conservation Work" (Guo Fa [2006] No. 28) and the "Notice of the State Council on Printing and Distributing the Comprehensive Work Plan for Energy Conservation and Emission Reduction" (Guo Fa [2007] No. 15), "11 During the five-year period, the state will arrange special funds to support enterprise energy-saving technological transformation (hereinafter referred to as energy-saving funds). In order to strengthen the management of financial funds and improve the efficiency of the use of funds, these measures are formulated.
Article 2 In order to ensure the actual energy-saving effect of the energy-saving technological transformation project, the energy-saving funds shall be rewarded, the amount of funds implemented shall be linked to the energy-saving amount, and the project undertaking enterprises that complete the energy-saving target shall be rewarded.
Article 3 The energy saving quantity shall be approved by means of enterprise report, third party audit, and government confirmation. The enterprise submits the energy use status, energy saving measures, energy saving quantity and measurement and detection methods before the transformation, and is audited by a third party agency entrusted by the government. The third party organization is responsible for the energy saving audit report issued.
Article 4 The awards for energy conservation funds shall be open and transparent, and shall be subject to supervision by all sectors of society.
Article 5 The energy conservation funds referred to in these Measures refer to the funds allocated by the central government budget and are used exclusively to reward enterprises for energy-saving technological transformation projects.
Chapter II Reward Objects and Ways
Article 6 The energy-saving technological transformation project of financial incentives refers to the transformation of coal-fired industrial boilers (kilns) determined in the “Implementation Opinions of the Ten Key Energy-Saving Projects of the Eleventh Five-Year Plan†(No. 5, No. 1457). Residual heat and residual pressure utilization, conservation and replacement of petroleum, motor system energy conservation and energy system optimization projects.
Article 7 The financial incentive funds are mainly to support the enterprise's energy-saving technological transformation projects. The amount of awards is determined according to the actual energy savings of the project and the required reward criteria.
Chapter III Award Conditions
Article 8 Projects applying for financial incentives must meet the following conditions
(1) Approved, approved or filed by the Development and Reform Commission or the Economic and Trade Commission and the Economic Commission;
(2) It belongs to the energy-saving technological transformation project;
(3) The energy saving amount is above 10,000 tons (tentatively) standard coal;
(4) The project undertaker must have a sound energy measurement, statistics and management system.
Chapter IV Awards
Article 9 The energy-saving technological transformation project in the eastern region shall be rewarded according to the energy saving amount of 200 yuan/ton of standard coal, and the central and western regions shall be awarded by 250 yuan/ton of standard coal.
Article 10 Energy conservation is directly generated by enterprises through energy-saving technological transformation projects and can be approved.
Chapter V Declaration, Examination and Release of Award Funds Article 11 The energy conservation technology transformation project that meets the provisions of these Measures shall be submitted by the enterprise and signed by the legal representative. The specific requirements are attached.
Article 12 In accordance with the principle of territorial declaration, an enterprise shall report the application for financial energy-saving incentive funds to the competent department of energy conservation (Development and Reform Commission, Economic and Trade Commission, Economic Commission, the same below) and the financial department. The provincial-level energy-saving competent department, together with the financial department, conducts a strict preliminary examination, confirmation, and summary of the enterprise energy-saving fund application report, and then reports it to the National Development and Reform Commission and the Ministry of Finance. The enterprises directly under the Central Government directly report to the National Development and Reform Commission and the Ministry of Finance, and copy the local provincial energy conservation authorities and financial departments.
Article 13 The National Development and Reform Commission and the Ministry of Finance shall review the experts who apply for the report of the financial energy-saving incentive funds reported locally. The National Development and Reform Commission determines the amount of project awards according to the award criteria, issues the implementation plan for the energy-saving technological transformation project, and sends a copy to the Ministry of Finance.
